The U.S. Department of Health and Human Services (“HHS”) has issued a final rule which, among other things, changes the annual Health Insurance Marketplace open enrollment period for the 2018 plan year and modifies the rules for Marketplace special enrollment periods.

Benefits Pro Daily:  Chief Executive Officer Joseph Swedish said on a conference call Wednesday that the insurer would raise its rates by 20 percent if the subsidies aren’t paid to insurers.

The New York Times  (4/10, Pear, Subscription Publication) reports that HHS “says it is willing to continue paying subsidies to health insurance companies under the Affordable Care Act even though House Republicans say the payments are illegal because Congress never authorized them.” The Times says the statement “sends a small but potentially significant signal to insurers, encouraging them to stay in the market.”
